The Officer Commanding Station (OCS) at Lumakanda Police Station in Lugari Sub-County, Kakamega County, has been charged over the alleged defilement of a 14-year-old girl.
The accused appeared before Senior Resident Magistrate Dorcas Mac’andere. However, prosecutors opposed his release on bail or bond.
OCS faces three charges
According to the Office of the Director of Public Prosecutions (ODPP), the police officer faces three charges linked to the alleged offences.
These include defilement, committing an indecent act with a child and abuse of a position of authority.
The ODPP said the main defilement charge falls under Section 8(1), as read with Section 8(3), of the Sexual Offences Act No. 3 of 2006.
In addition, the officer faces an alternative charge of committing an indecent act with a child under Section 11(1) of the Act.
Meanwhile, prosecutors charged him with abuse of a position of authority under Section 24(2) of the same law.
Prosecution opposes bail
The prosecution told the court that the alleged offences occurred between September 24 and September 27, 2026.
According to the prosecution, the case involves a 14-year-old girl.
For this reason, prosecutors opposed the officer’s bail and bond application. They argued that the alleged offences were serious.
As a result, the court ordered that the accused remain in custody while it considers the bail application.
Court to decide bond terms
The court will determine the bond terms on October 1, 2026.
Until then, the accused will remain in custody.
At the same time, he remains presumed innocent unless the court finds him guilty.
