A court has sentenced 79-year-old John Mwangi Thuku to 10 years in prison for committing an indecent act with a 14-year-old autistic child.
The Office of the Director of Public Prosecutions (ODPP) prosecuted the case.
Incident happened in May 2025
The case relates to an incident that occurred on May 1, 2025.
According to the prosecution, the child had wandered away from home. Her mother searched for her and later found Thuku engaging in inappropriate sexual conduct with the minor.
The mother raised an alarm after discovering the incident. Neighbours then rushed to the scene.
Prosecution calls seven witnesses
Authorities initially charged Thuku with attempted defilement under Section 9(1), read together with Section 9(2) of the Sexual Offences Act.
Principal Prosecution Counsel Elizabeth Waruguru and Prosecution Counsel Sarah Kitui led the prosecution during the trial.
The two lawyers called seven witnesses to support the case.
Although the child could not testify, the court found enough supporting evidence to prove the case.
The evidence also established Thuku’s identity and conduct beyond reasonable doubt.
Court hands Thuku 10-year sentence
The court convicted Thuku of committing an indecent act with a child under Section 11 of the Sexual Offences Act.
The court reached the conviction under Section 179 of the Criminal Procedure Code.
