An Eldoret court has ordered the arrest of a Kenyan nurse living in the United States. The court says he failed to obey orders to support his three-year-old daughter.
Senior Principal Magistrate Cheronoh Kesse issued the warrant. The case involves Noah Kibet Mutai and his former wife, Nancy Jemutai Samoei.
The magistrate directed the Officer Commanding Station (OCS) at Jomo Kenyatta International Airport (JKIA) to arrest Mutai when he arrives in Kenya. Police must then present him before the court to face contempt of court proceedings.
On July 17, 2024, the court ordered Mutai to pay Ksh.20,000 every month for the child’s upkeep and related expenses. Nancy says he has not complied with that order.
Nancy told the court that she moved back to her parents’ home in Kapseret after their marriage ended. She said Mutai later relocated to the United States, where he found work as a nurse.
The couple married in December 2020 and have one daughter, identified in court records as A.M. Nancy claims Mutai has not contributed to the child’s financial needs despite the court order.
The case also involved a paternity dispute. Mutai denied fathering the child, prompting the court to order a DNA test in 2024. The test identified him as the child’s biological father.
Mutai later challenged the DNA results. He claimed they had been altered and asked the court to order a fresh, supervised DNA test.
The court will give further directions after police arrest Mutai and bring him before the magistrate.
